Privacy Policy
Introduction
EzMind Inc. (“EzMind Inc.,” “we,” “our,” or “us”) provides on-premises intelligence appliances, software, and support services under the product name EzMind. This policy explains what information EzMind Inc. collects, how we use it, and your choices.
Information We Collect
EzMind Inc. collects only the information needed to provide our services:
- Contact data you submit, such as name, email, phone, company, and request details
- Website usage data, such as browser/device type, IP address, and page interactions on ezmind.us
- Support data you provide during troubleshooting, diagnostics, and implementation
- Demo and inquiry data when you request information about EzMind products
Local-First Product Architecture
EzMind products are designed for local-first operation. When an EzMind appliance is deployed at a customer location, the operational data the system handles — including the customer shop's records, customer information, vehicle histories, financial data, and SMS message content — resides on hardware physically located at the customer's premises and under the customer's control.
EzMind Inc. does not have access to, collect, or store the operational data on customer-deployed EzMind appliances. EzMind Inc.'s role is to provide the appliance, the software, and ongoing support. The data the appliance handles in normal operation belongs to and remains with the customer.
The only exceptions are when a customer explicitly authorizes a remote service path for diagnostics or support, in which case access is limited to the specific issue and the specific data necessary to resolve it.
Messaging Data
When EzMind's messaging features are enabled, SMS messages flow through the Twilio platform. EzMind Inc. provides the messaging engine; the messaging itself operates under separate Twilio accounts owned by either EzMind Inc. (for direct EzMind Inc. communications) or by the customer shop (for shop-to-customer messaging via the ISV subaccount architecture). See our SMS Messaging Terms for details.
How We Use Information
EzMind Inc. uses information we collect to:
- Provide, maintain, and improve EzMind products and services
- Deliver onboarding, support, diagnostics, and service communications
- Process demos, inquiries, and customer relationship requests
- Detect, prevent, and address fraud, abuse, and technical issues
- Meet legal, regulatory, and contractual obligations
Data Sharing
EzMind Inc. does not sell personal data. We share limited information only with service providers required to deliver our services (such as Twilio for messaging infrastructure, payment processors for billing, and email service providers for transactional communications), under appropriate contractual safeguards.
Your Rights
You may request access to, correction of, or deletion of personal data EzMind Inc. holds about you by emailing support@ezmind.us. We will respond within a reasonable timeframe consistent with applicable law.
Security
EzMind Inc. uses administrative and technical safeguards designed to protect data. The local-first architecture of EzMind products means that the most sensitive customer data — operational shop records — is protected by remaining on customer-controlled hardware rather than passing through EzMind Inc.'s systems. No method of transmission or storage is guaranteed to be 100% secure.
Children's Privacy
EzMind products are intended for business use. EzMind Inc. does not knowingly collect personal information from children under 13.
Policy Updates
EzMind Inc. may update this Privacy Policy periodically. Updates take effect when posted on this page. Material changes will be communicated by email to customers and prospects who have provided email contact information.

Terms of Service
Agreement
By accessing the EzMind Inc. website at ezmind.us or by purchasing, deploying, or using EzMind products and services, you agree to these Terms. If you do not agree, do not use the website, products, or services. EzMind Inc. (“EzMind Inc.,” “we,” “our,” “us”) provides intelligence appliances and software under the product name EzMind.
Website License
EzMind Inc. grants a limited, revocable, non-transferable license to access and use ezmind.us website materials for informational purposes.
- You may not copy, republish, or redistribute protected content without permission
- You may not reverse engineer restricted website software components
- You may not remove copyright, trademark, or proprietary notices
- You may not use website materials in unlawful or misleading ways
EzMind Products
EzMind products consist of a hardware appliance manufactured by EzMind Inc. and the EzMind software preinstalled on that appliance. Products are deployed at customer locations and operate on customer premises under the customer's control.
Hardware Ownership
Upon completion of purchase or completion of all financing payments (whichever applies under the customer's purchase agreement), the customer owns the EzMind hardware appliance outright. EzMind Inc. retains no ownership interest in deployed hardware. The customer is free to keep, relocate, service, or eventually dispose of the appliance as their own property, subject only to the software license terms below.
Software License
EzMind Inc. retains all intellectual property rights to the EzMind software. Upon purchase, the customer receives a perpetual, non-transferable license to use the EzMind software on the specific hardware appliance it was installed on. The license includes:
- The right to use the EzMind software in normal business operation indefinitely
- The right to continue using the software after any service or update subscription ends
- No requirement to maintain an ongoing subscription to keep using the core software
The license does not include:
- The right to copy, distribute, or sublicense the EzMind software to other parties
- The right to reverse engineer, decompile, or extract the software for use elsewhere
- The right to transfer the software license to hardware other than the original appliance
Service Subscription (Optional)
EzMind Inc. offers an ongoing service subscription that provides software updates, new feature deployments, technical support, and platform maintenance. The service subscription is optional. Customers who choose not to subscribe retain full use of the EzMind software as deployed at the time of purchase, but will not receive ongoing updates or technical support beyond what is included in the initial purchase.
Financing
EzMind Inc. may offer in-house financing for product purchases. When financing is selected:
- The customer takes possession of the hardware and begins using the EzMind software upon installation
- Monthly payments continue for the term specified in the customer's signed financing agreement
- Hardware ownership transfers to the customer upon completion of all financing payments
- The software license terms above apply throughout the financing period and continue thereafter
- Default on financing payments is governed by the signed financing agreement and applicable Florida law
The signed customer financing agreement controls in any conflict with these general Terms.
Installation
EzMind Inc. provides on-premises installation services for new customer deployments. Installation includes hardware setup, network configuration, data ingestion from the customer's existing systems, and operational handoff. Specific installation scope is defined in the customer's signed installation agreement or service order.
Trial Period
Customer purchase agreements may include a trial period during which the customer may return the EzMind appliance for a refund of payments made, subject to the specific terms in the signed customer agreement. Trial terms vary by customer and are defined per agreement.
Customer Agreements
Product deployments, support coverage, warranty terms, financing terms, and service obligations are defined in signed customer documents specific to each deployment. Where signed customer documents address topics covered in these general Terms, the signed customer documents control.
Disclaimer
Website materials and EzMind products and services are provided “as is” and “as available.” To the fullest extent permitted by law, EzMind Inc. disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
EzMind Inc. does not warrant that the EzMind software will be uninterrupted, error-free, or capable of meeting every operational need of every customer. Customers are responsible for evaluating EzMind's suitability for their specific business operations during the trial period.
Limitation of Liability
To the fullest extent permitted by law, EzMind Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption. EzMind Inc.'s total cumulative liability under these Terms or any customer agreement shall not exceed the total amount paid by the customer to EzMind Inc. in the twelve months preceding the claim.
Indemnification
The customer agrees to indemnify and hold EzMind Inc. harmless from claims arising from the customer's use of EzMind products in violation of these Terms or applicable law, including but not limited to claims related to the customer's use of EzMind's messaging features to send communications that violate telecommunications law or consumer protection regulations.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any disputes arising under these Terms shall be brought in the courts of Brevard County, Florida, or in the federal courts located in the Middle District of Florida.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Changes to Terms
EzMind Inc. may update these Terms periodically. Material changes will be posted on this page and communicated to active customers by email. Continued use of EzMind products or services after Terms are updated constitutes acceptance of the updated Terms.

SMS Messaging Terms
Introduction
EzMind Inc. (“EzMind Inc.”) operates SMS messaging in two distinct contexts. These Terms explain both, including how messages originate, what types of messages you may receive, and how to opt out.
The Two Messaging Contexts
Context 1: Direct EzMind Inc. Messaging
EzMind Inc. sends SMS directly to customers, prospects, and partners using EzMind Inc.'s own Twilio account. These messages come from EzMind Inc.'s registered business phone number(s) and are sent on EzMind Inc.'s behalf for purposes including:
- Demo booking confirmations and reminders
- Customer support communications
- Service notifications about purchased EzMind products
- Platform updates and operational alerts to active customers
When you receive a message from EzMind Inc. directly, EzMind Inc. is the message originator and is responsible for the messaging program.
Context 2: Customer Shop Messaging via EzMind Platform
EzMind Inc. provides messaging infrastructure to businesses that purchase EzMind products. When a business (such as an auto repair shop) deploys EzMind, that business may use EzMind's platform to send SMS to its own customers. In this context:
- The business operates its own dedicated Twilio subaccount provisioned through EzMind Inc.'s ISV platform
- The business owns its phone numbers, pays its own Twilio billing, and registers its own 10DLC brand and campaigns
- The business is the legal message originator and is responsible for the content, frequency, and compliance of messages sent to its customers
- EzMind Inc. provides the technical infrastructure that enables the messaging but does not originate, author, or hold legal responsibility for messages between the business and its customers
- The business's customer relationship is between the business and its customer; EzMind Inc. is not party to that relationship
If you have received an SMS message and want to know which context applies, check the sender phone number. EzMind Inc. messages come from EzMind Inc.'s registered number. Customer shop messages come from the shop's own number and typically identify the shop in the message content.
Message Types
In both contexts, messages are transactional in nature. They include things like:
- Appointment confirmations and reminders
- Service status updates
- Estimate notifications requiring approval
- Vehicle ready notifications and payment links
- Account and support communications
Messages are not marketing or promotional in nature unless you have provided separate, explicit opt-in consent for marketing messages from the specific sender.
Message Frequency
Message frequency varies by sender context and by your activity. For messages sent directly by EzMind Inc., frequency typically ranges from 2 to 5 messages per month.
For customer shop messaging through the EzMind platform, frequency is transactional and event-driven, not a monthly marketing cadence. You may receive multiple messages tied to a single repair order or service event (for example estimate sent, approval received, vehicle ready, payment confirmation), and the number of messages depends on your real service activity with that specific shop.
Message and Data Rates
Standard message and data rates from your mobile carrier may apply to any SMS you receive. EzMind Inc. and the customer shops using EzMind do not charge you for messages; carrier rates are between you and your carrier.
Opt-In and Consent
By providing your phone number to EzMind Inc. or to a business using EzMind, and by interacting in a context that triggers SMS communication (such as booking a demo, becoming a customer, or providing your phone number to a shop), you consent to receive transactional SMS messages relevant to that relationship. Consent can be withdrawn at any time using the opt-out methods below.
Opt-Out
To stop receiving SMS messages from any sender using the EzMind platform or from EzMind Inc. directly:
- Reply STOP to any SMS message. This will opt you out of further messages from that specific sender. Opt-out is processed automatically by the messaging platform.
- For EzMind Inc. direct messaging, you may also email support@ezmind.us with the phone number you want removed.
- For messages from a customer shop using EzMind, you may also contact the shop directly. Each customer shop maintains its own customer relationship and can process opt-out requests through its own channels.
Opt-out from one sender does not opt you out from other senders using the EzMind platform. If you wish to opt out of multiple senders, reply STOP to each, or contact each sender separately.
HELP
Reply HELP to any SMS message to receive support information. For EzMind Inc. direct messaging, HELP responses come from EzMind Inc. For customer shop messaging, HELP responses come from the specific shop or include the shop's contact information.
You may also contact EzMind Inc. at support@ezmind.us for questions about the EzMind messaging platform itself, including technical issues with message delivery or opt-out processing.
Data Handling
SMS-related data is handled according to our Privacy Policy. For EzMind Inc. direct messaging, your phone number and message history are stored in EzMind Inc.'s systems for the purpose of message delivery and compliance. For customer shop messaging via the EzMind platform, your phone number and message content reside in the shop's EzMind appliance and in the shop's Twilio subaccount; EzMind Inc. does not store or have access to that data in normal operation.
Responsibility and Compliance
EzMind Inc. takes the following responsibilities as the SMS platform operator:
- Maintaining the technical infrastructure that enables messaging
- Registering as a 10DLC ISV with appropriate carrier oversight
- Providing compliance tools and guidance to customer businesses using the platform
- Operating EzMind Inc.'s own direct messaging in compliance with all applicable laws
Customer businesses using EzMind for shop messaging take responsibility for:
- Obtaining appropriate consent from their own customers before sending messages
- Sending only the message types they have registered for under their own 10DLC campaign
- Honoring opt-out requests from their own customers
- Complying with telecommunications laws including the Telephone Consumer Protection Act (TCPA) and applicable state regulations
Changes to These Terms
EzMind Inc. may update these SMS Messaging Terms periodically. Material changes will be posted on this page. Continued participation in SMS messaging after Terms are updated constitutes acceptance of the updated Terms.
